#Ethiopia 21 years ago in 1994 with Sheikh Muhammad Ali Alamudi. Mr. Abnet Gebre Meres, who was the manager of the "Bole Towers Limited Liability Company" which he established in partnership, was determined by the court that he had never called a meeting of the members of the association or kept minutes of the meeting and that the association did not have an annual statement of assets and liabilities or a balance sheet. .
Five years ago, after going to Saudi Arabia at the invitation of the crown prince of Saudi Arabia, Mohammed bin Salman, Sheikh Mohammed Ali Al-Amoudi, who was imprisoned for the winter and later released, but has not yet been able to return to Ethiopia, was arrested by three lawyers hired two years ago in 2013. They filed a lawsuit against Mr. Abnet in the fifth trial of the Federal Court of First Instance, Trade and Investment Division.
The lawsuit explains that the origin or reason of the lawsuit is "Bole Towers Limited Liability Company" in which Sheikh Mohammed owns 60 percent and Mr. Abnet 40 percent. It is mentioned in the lawsuit that Mr. Abnet was appointed to lead the company as a manager and that he was given the responsibility to fulfill his responsibilities according to Article 516 of the Commercial Code and the articles of incorporation and by-laws of the company.
According to the provisions of the Civil Code No. 2208 and 2209, they were legally obliged to fulfill their duties, but they failed to fulfill their obligations. The lawsuit explains that Mr. Abnet transferred the 3,383 square meter and 1,971 square meter plots in Kirkos Sub-city, which belonged to the association and cost more than 120 million birr, to himself. He also added that they caused damage to the plaintiff.
The lawsuit explains that although the plaintiff has the right to know the state of the association's assets, to know the detailed balance sheet, audit report, meeting minutes and other documents, the association has refused to provide them since its establishment. The other case filed by the plaintiff is that Mr. Abnet borrowed 425 million Birr on behalf of the association and used it for personal use. Therefore, the plaintiff, through his lawyers, asked the court to decide on the cases mentioned by Mr. Abnet as the manager of the association, to hand over the association's property and documents, to examine the association's accounts, and to decide on other damages mentioned in the lawsuit.
In the answer to the case presented to the court by Mr. Abnet through the five lawyers he hired, the plaintiff asked the court to dismiss the case as it is beyond the scope of the court's jurisdiction. In response, he pointed out that the defendant used the property for which the plaintiff had spent 120 million birr for personal use and borrowed 425 million birr on behalf of the association for personal use. Ato Abnet has filed a listless case against the plaintiff and he has a listless answer
